Am I Going to Lose My Driving Licence?

This calculator provides an instant assessment of your driving ban risk based on your current penalty points and the nature of the new offence you are facing. It takes into account the UK's totting up provisions under section 35 of the Road Traffic Offenders Act 1988 and the sentencing guidelines for serious offences.

The 12-Point Rule

Accumulating 12 or more penalty points within any 3-year period triggers a mandatory minimum 6-month driving disqualification under s.35 RTOA 1988, unless exceptional hardship can be shown.

Exceptional Hardship

Even if you reach 12 points, our solicitors have a 94% success rate in preventing bans by arguing exceptional hardship — demonstrating that disqualification would cause disproportionate suffering to you or your dependants.

Serious Offence?

Drink driving and drug driving carry mandatory disqualifications regardless of existing points. Dangerous driving typically results in a Crown Court ban. These charges require immediate specialist representation.

What Do the Risk Levels Mean?

LOW

Lower Risk

You would have fewer than 9 points after the new offence and are not facing a mandatory ban. You still have a legal record and insurance implications to consider. Legal advice may minimise the endorsement.

MED

Moderate Risk

You would have 9–11 points. You are close to the 12-point threshold. Any further offence could trigger a totting up ban. A solicitor can challenge the current charge to keep you below 12 points.

HIGH

High Risk

You would reach or exceed 12 points, triggering the totting up provisions. You need a solicitor to prepare and present an exceptional hardship argument at your hearing. Act immediately.

CRIT

Critical Risk

A mandatory disqualification is almost certain for this offence type (drink/drug/dangerous driving) or you face a serious totting up situation. Specialist legal representation is essential.

Ban Calculator FAQ

You can check your driving licence information online at gov.uk/check-driving-information using your driving licence number and National Insurance number. Alternatively, you can request a driving licence summary by post from the DVLA. Your current paper counterpart (if issued before 2015) will also show historic endorsements.

Yes. Penalty points are recorded on your DVLA licence regardless of where in Great Britain the offence occurred. The drink driving limits are different in Scotland (lower), but convictions in Scotland are recorded on your UK licence and count towards the 12-point threshold everywhere in Great Britain.

Not on the same or substantially similar grounds within a three-year period. However, if the circumstances have materially changed — for example, you have taken on new caring responsibilities or started a new business — there may be fresh grounds available.
